Texas Supreme Court Justice Place 4 race heats up as grand jurors reveal the truth and seek to defend their integrity

AUSTIN, TX– Texas Alliance for Ethical Government released a new video and website this week to expose the deliberate smear campaign launched against the 1st Harris County grand jury that indicted Justice David Medina and his wife Francisca on felony arson related charges in 2008 through the organization’s public education project:  RunawayGrandJury.Org. 

The video titled, “Runaway Grand Jury….or Runaway Justice?” can be viewed at:  http://www.runawaygrandjury.org 

In an attempt to downplay the indictment of Justice Medina and discredit the grand jury, the Medina legal teams labeled the jurors as a “Runaway Grand Jury” and made statements implying they were all “agenda driven …liberal … Log Cabin Republicans … drunk with power … trying to rid Texas of conservative Republican judges.”

The hard-hitting video reveals the fact that the 1st grand jury was in truth comprised of a large number of “conservatives” and several very “staunch” Republicans as detailed on the website at Meet the Jury.  

Dave Welch,  Texas Alliance for Ethical Government board member stated, “Contrary to the character attacks launched by Medina’s legal team (often with Medina present) several of the jury members have served the Texas GOP as precinct chairs, state convention delegates, and convention committee members.”  Welch further added, “Oddly enough, there are 3 National GOP Convention delegates among the grand jury members that indicted Justice Medina and his wife in January of 2008.”  

After the 1st grand jury indictments were handed down against both David and Francisca Medina, the District Attorney’s office made the surprising discovery that they failed to “properly extend” the original term of that grand jury.  It seems incompetence ran as deep as cronyism and corruption during that time period in the Harris County District Attorney’s office. 

“Until now, the Medina legal teams got away with their efforts to discredit and silence the 1st grand jury, going so far as to ask the court to consider jail time and fines if the jurors dared defend their integrity or service as jurors,” said Alice Linahan, Texas Alliance for Ethical Government board member.  Linahan stated additionally, “With the true composition of the 1st grand jury finally revealed, it will be difficult for the public to believe that these jurors had an “agenda” as suggested or that two separate grand juries inHarrisCounty got it wrong two times in this one arson case.”

Several mysteries still remain in the Medina arson indictment saga.  What did happen to that letter that was the basis of Justice Medina’s felony indictment for “evidence tampering” – did it get lost on the way to the 2nd grand jury proceeding?

Why John Devine? Interview with Donna Garner: Judge John Devine, the Right Choice

Here is the interview that Terry Lowry of What’s Up Radio Program did with, Donna Garner.  The subject is Judge John Devine v. David Medina for the Texas Supreme Court, Associate Supreme Court Justice, Place 4.  

This race is statewide and is on everyone’s ballot in the run-offs. Early voting started this last Monday and runs through this Friday, July 27, with the actual run-off race to be held on July 31, 2012.

  Justice David Medina – Unfit for Duty

Modern political conservatism is and must have its foundation the absolute commitment to truth, integrity, and character exemplified in faithful adherence to Judeo-Christian principles as espoused in our U.S. Constitution regarding civil government. Any breakdown in the first set of qualities inevitably leads to corruption of the practice. In other words, character and morals will dictate performance and when the sword of justice is at stake, the character and morals must be unimpeachable.

That is the primary issue at hand in regards to Texas Supreme Court Justice David Medina. The issue is whether he is ethically and morally fit to sit on the highest court in Texas rendering judgments that impact millions of people after significant evidence of corrupt behavior that includes indictments by a grand jury, of which some members I know personally and trust implicitly.

I challenge any who would like to dismiss this documentary out of hand to set aside political allegiances and agendas for a few moments for the sake of watching and listening with an open mind. Being well familiar with this drama since the story of the fire at the Medina home first broke in the media setting off this chain of events, I believe there is ample reason to accept the credibility of the initial indictments. I was also one of the first to publicly call for Chuck Rosenthal’s resignation as Harris County District Attorney due to – ironically enough – clear moral and ethical failure that cast significant doubt on whether he had been or could be serving the public with integrity. The evident cronyism involved in the quashing of the indictments of the Medinas was glaring and troubling to say the least.

It is completely incredible – even comical – to assert that either the majority of the grand jury or the team who produced this documentary are anti-death penalty, are liberals trying to take down a conservative judge or have any other ulterior motive. The very makeup of the grand jury including experienced law enforcement professionals and some known, rock solid, conservative Christian Republican leaders defies that mistype.

The desperate ravings of Medina’s defense attorney and political team are stereotypical – if you don’t have a case attack the witnesses. I’ve watched this tactic in the courtroom and the legislative chamber for 30 years.

Justice David Medina is a man in need of transformation and redemption, but must first come face to face with the fact that he has violated the trust of the people and been proven unfit to sit on the highest bench of justice in this great state. We the people will be judged with him if we show contempt for bankruptcy of moral and ethics by those we place in positions of public trust.
