Abuses of Tolling
Pay-as-you-go funding of road construction can be done with a comprehensive transportation package, which should include:


  • State government restructuring to eliminate overlapping, duplicated effort;phase-out of funding for budget items beyond the core constitutional responsibilities of state government;
  • TxDOT operational reforms & increased transparency;
  • Reigning in flagrant waste (documented) via “local control” RMAs, MPOs and COGs spending millions on “enhancements”;
  • Refocus on building highways to relieve traffic congestion – not funding light rail, street cars, biking/hiking trails, parks and roads for economic development (the “build it and they will come” scenario);
  • Ending diversions;
  • Dedicating vehicle sales and use tax revenue to highway construction (the Nichols Plan – SB 287);
  • Early debt retirement, if approved by the people (the Eltife Plan – Constitutional Amendment via SJR 47)

Reforms Required as part of the package:


  • Return to pay-as-you-go; no more public road debt (state or local).
  • Make all toll viability studies OPEN to the public (currently kept SECRET) – (HB 2870 – Capriglione)
  • No more Public Private Partnerships (P3s), handing control of our Texas infrastructure to private, even foreign, corporations. This applies to roads and other public facilities such as the Capitol Complex. No more use of eminent domain for private gain.
  • No more public subsidies, credit enhancements, or loan guarantees for any type of toll project.
  • Comprehensive financial audit of TxDOT prior to the agency’s next sunset review in 2015 to gain efficiencies and end practices that drive-up costs, e. g., Design-Build CDAs, P3s, and multi-million dollar “enhancements” that have nothing to do with moving traffic.

New Revenues:


  • End diversions of all road user fees (motor fuel tax, vehicle sales tax, tire sales, auto parts sales tax) to non-transportation uses.
  • Phase-in motor vehicle sales/use tax revenues to the Highway Fund, consistent with Nichols’ SB 287.

Constitutional restrictions on the use of New Revenues


  • No diversions: May only be used for planning, design, construction of new state highway system road capacity and the maintenance of this new capacity once built.
  • Not Used for Toll Roads: May not be used on comprehensive development agreements or projects involving the construction of toll lanes.
  • No Debt: Shall be used for pay-as-you go projects and may not be used as backing for new debt financing (whether at the state or local level).
  • No non-road expenditures: None of these funds may be used for any expense related to bike trails, transit or pedestrian walkways.

The Problem: Anti-liberty Legislation is ALIVE and WELL in Austin!  Establishment Republicans who do not share our values have plans for you:

  • Plans to mushroom state debt with 100 YEAR BONDS.
  • Plans to push debt down to the local level, opening the door for MORE PROPERTY TAX INCREASES.
  • Plans to hand out more taxpayer dollars to well-connected special interests via CORPORATE WELFARE.
  • Plans to SABOTAGE THE TERM LIMITS BILLS in the House and Senate.
  • Plans to build ALL future state highways as CORPORATE TOLL ROADS and sell them off to foreign multinationals (the TransTexas Corridor plan blown up all across the state).
  • Plans to use eminent domain power for PRIVATE GAIN via transportation policy.
  • Plans to continue the ACCOUNTING GIMMICKS and SMOKE AND MIRRORS to “balance” the state budget on paper while running up more debt.
  • Plans to expand Medicaid in the quest for ObamaCare dollars–bankrupting our state in the process.

Nobody’s coming to save us–but US!       


Watch out for liberal and moderate legislators signing up to support Second Amendment and pro-life legislation while stealing your liberty and your children’s future!  Don’t be fooled!  We must look at THE ENTIRE RECORD — not just the easy votes.  It’s easy to support the 2nd Amendment and be pro-life in Texas…even liberal Republicans can, but they hide a multitude of other sins under those two important issues, hoping you won’t look at the rest of their record!  Don’t let them get away with it!

David Dewhurst and His Dishonest Campaign

On 7.6.12, I published “Why Choose Ted Cruz Over David Dewhurst for U. S.Senate?”  Since then new evidence has surfaced that confirms what I said in my article.  David Dewhurst, Texas’ present Lt. Governor, is a self-serving, left-leaning politician who is not above using unethical means to try to win this U. S. Senate election.

On 6.28.12, Peggy Fikac (reporter for San Antonio Express-New) stated that in a 2007 speech, “Lt. Gov. David Dewhurst, who in his U.S. Senate debate with Ted Cruz days ago adamantly opposed a guest-worker program ‘until and unless’ the border is secured, supported a guest-worker program ‘for those here today illegally.’ ”

Almost immediately after Fikac unveiled Dewhurst’s 2007 speech, it was scrubbed from the official, state-taxpayer-supported, Lt. Governor’s website — (7.11.12 – “Dewhurst Speech Backing Guest worker Program Removed from Official Website”

Young Conservatives of Texas has filed an open records request asking to see “recorded conversations between Dewhurst’s office and the secretary of Senate regarding the archiving request. YCT also wants to see the archived speeches made available to the organization, and the dates and times of the requests to remove the speeches from the website” (http://blog.chron.com/texaspolitics/).

Voters need to learn as much as possible about these two candidates – Ted Cruz and David Dewhurst.

For brevity’s sake, I have excerpted only my comments about David Dewhurst:


Many people who actually work with David Dewhurst in the Texas Legislature do not like him and have made the following comments as reported by the media: “People hold him in no regard. Not high. Not low. No regard…He’s never shown himself to be knowledgeable…He’s just inept…He’s weird…He’s aloof and off-putting…He is stiff and joyless…He’s a fake.”


David Dewhurst went to Lamar High in Houston, attended the U. of Arizona, and went into the Air Force for a brief time in 1971.  He then started working for the CIA in Bolivia during a coup operation.

When Dewhurst quit the CIA and came back to Texas, he established his oil and gas company (Falcon Seaboard) during the big energy surge in Texas. This helped him to be able to borrow enough money to build several power plants, buy a 42,723-acre ranch near Sonora, a 3,000- acre ranch in Colorado, another ranch in Nebraska, and a ranch in Fredericksburg where Dewhurst breeds quarter horses and cattle.

In 1995 David married a model — a “trophy wife” named Tammy Jo Hopkins  — who was 18 years younger than he was.  She had been Miss Teen USA and spent money loosely.  David and Tammy’s credit card bills were said to have reached $50,000 each month; and the elitist couple bought a 13,000 square-foot mansion in the River Oaks section of  Houston, a condo in Santa Fe, and an elaborate house in Pemberton Heights in Austin.

With all that wealth came alcohol problems; and in 1999, while Tammy was driving her new Mercedes, she crossed the center stripe, hit an elderly couple, was charged with driving while intoxicated, was fined $1,200, served one year of probation doing community service, and filed for divorce from David Dewhurst.

In Feb. 2009, Dewhurst announced that he planned to marry former Tex. State Senator Teel Bivins’ ex-wife, Patricia Hamilton “Tricia” Bivins.

Later in the same year (Oct. 2009), Teel Bivins died at age 61 of Progressive Supranuclear Palsy.  He had been diagnosed with the disease in 2004 while he was the Ambassador to Sweden, appointed by President George W. Bush.

[When Sen. Teel Bivins became the Ambassador, Kel Seliger took Bivins’ place in the Senate.]

Tricia and Teel had one child, Carolyn, who was close to five years of age when David Dewhurst and Tricia married.

The order of events seems to have been — Dewhurst divorced his first wife; Tricia divorced Teel Bivins; Tricia married Dewhurst; four month later, Teel Bivins died.


During the 1990’s, David Dewhurst gave half a million dollars to the Republican Party and to GOP candidates who responded in kind to support him in his race in 1997 when he ran for the General Land Commissioner.  Dewhurst spent $4 Million of his own money to win the race.

In 2000 while at the General Land Office, he had a public feud with Republican Comptroller Carol Keeton Rylander in which she said he owed the state $1 Million in taxes for luxury items that he had imported from other countries.

All sorts of rumors abounded while Dewhurst was at the General Land Office — some even questioning his sexual identity even though he was seen with “young, leggy, blonde women.”

Then in the elections of 2002, David Dewhurst (Republican) ran against John Sharp (Democrat) for the Lt. Governor’s seat.  Dewhurst won this election because of having “bought” the race for himself out of his $200 Million in personal wealth.

John Sharp had served in the Texas House, the Texas Senate, the Texas Railroad Commission, and as Comptroller.  Dewhurst had only served a few years in the General Land Office.

In that campaign Dewhurst ran a four-page spread and featured a photo of himself dressed as a soldier, standing in front of the American flag. One glitch: Dewhurst was dressed in a German general’s uniform.

Many well-known Republicans and state-wide interest groups endorsed Democrat John Sharp because they said they knew and trusted him and did not feel the same about Dewhurst. These were Nolan Ryan, Sen. John Carona, the Texas Association of Business and Chambers of Commerce, Texas Medical Association, Texas Association of Realtors, Independent Bankers Association, Texas Civil Justice League, Farm Bureau, Texas and Southwestern Cattle Raisers Association.

Dewhurst’s limited endorsements included Texans for Lawsuit Reform and the Texas Restaurant Association PAC, but Dewhurst relied upon his vast millions to “buy” the Lieutenant Governor’s seat for himself.

Years later, will David Dewhurst be able to “buy” the U. S. Senate seat for himself in the same way that he has used his own personal millions to “buy” his General Land Commissioner and Lt. Gov. seats?

This time it looks as if Dewhurst’s personal fortune may not be enough to offset the huge outpouring of support for Ted Cruz.

Dewhurst’s millions were not able to generate the votes to boost him above 50% in the primary elections, and he and Ted Cruz are locked in a run-off that will be decided on July 31, 2012.

Early voting is from July 23 – July 27.  My husband and I always vote early so that if we die before election day, our ballots will already be counted. You may feel the same.

Is David Dewhurst Dishonest? Operation “Whitewash”

The Power of Knowledge~ Political propaganda is exposed and Texans are educated voters.

“A few weeks ago, the text of a speech by Dewhurst for the Mr. South Texas award on Feb. 17, 2007 had appeared on the taxpayer funded Lt. Governor website. The speech contained the following line: “I support a guest worker program for those here today illegally.”

Then, on June 27, when the Dewhurst campaign released an ad opposing President Obama’s amnesty plan, the Houston Chronicle linked to the speech in a story with this headline: “Dewhurst in 2007 supported guest worker program ‘for those here today illegally.’”

Just recently, the Cruz campaign became aware that the speech had been removed from the official Lt. Governor website and is now a dead link.

It’s remarkable — David Dewhurst has gone from whitewashing his record to literally deleting it, but Texans aren’t fooled. Thanks to the wonders of modern technology, David Dewhurst’s words in support of amnesty were preserved for all the public to see.

Operation Whitewash comes as the Dewhurst campaign was recently exposed for running a “fact check” Twitter account and failed to disclose ties to it.”

Propaganda: The Establishment ~vs~ We The People

“In case you missed the first one-on-one debate for the U.S. Senate race between Ted Cruz and David Dewhurst, here’s a nugget you will not want to miss.

Dewhurst flat-out denied ever supporting a payroll tax, yet here’s a link to the press release his own office put out bragging about its passage: http://www.ltgov.state.tx.us/prview.php?id=75. (Note: “Texas businesses will have a choice of paying either a low-rate revised franchise tax or a payroll tax.”)

CRUZ: Lt. Gov. Dewhurst, you have been widely criticized for having proposed a statewide wage tax, a payroll tax that would have been 2.5% of the wages of every employee. Your response is to call your critics liars. So I have a very simple question, did you support a payroll tax? Yes or no and is that a good idea?

DEWHURST: No and no.

CRUZ: You did not support a payroll tax?

DEWHURST: No, I’ve never supported a wage tax and I’ve never supported a payroll tax. Umm

CRUZ: Well, that’s very interesting. I’ll point out at the end of this that we have over two dozen newspaper articles that are contemporaneous, quoting the Lt. Governor supporting a payroll tax. So we can now compare the facts to what he just told a television audience.”

Appropriated Conservative Labeling


A rash of groups have popped up in Texas claiming the conservative mantel. These new groups are careful to work the word conservative into their branding, but conservative consumers are becoming wise to their tactics and agendas.

Recently Texans with Republican ties on Facebook have been served ads from The Texas Conservatives Fund. It’s Facebook page is designed for a quick glance of the groups “values” leading to a “like” solicitation. The page is cryptic. Even the about isn’t particularly insightful, “to promote Texas Conservative Values for the GOP nomination for Texas in the US Senate in 2012.”

So this group will back whoever wins the GOP run-off in the November election? Nope.

To get an upfront account of what the Texas Conservative Fund is you have to navigate to its website to see it was created to “promote David Dewhurst’s candidacy for the GOP nomination for the US Senate in 2012.” Texas Conservative Fund’s Facebook sneakiness is suspicious given the group’s recent streak with liberal ties employing similar tactics.

Exposed liberal front group Honest Texans has been running the same scheme for a year to grow it’s following. Luckily the Trojan Horse was exposed as a liberal front before it could activate a tricked audience.

Then we have Conservative Voters of Texas. This PAC was set up by Steve Mostyn, Texas’ George Soros-esque mega-donor. Mostyn spent over $10 million in 2010 to help elect Democrats across Texas including Bill White. Mostyn’s stooge front man Mark McCaig launched Conservative Voters of Texas to play in GOP primaries in 2012. McCaig, a former member of the State Republican Executive Committee and Conservative Voters of Texas, had a short shelf life after he was outed by Texans for Lawsuit Reform.

Like Mostyn’s group, the Texas Conservative Roundtable launched in 2012 to undermine conservatives by posing as a conservative group. TXCR was quickly discredited when it released a flawed and blatantly crony scorecard. Shortly after it’s scorecard debacle the Roundtable was directly linked to embattled House Speaker Joe Straus.

Steer clear of tricks. Texans are getting wise and even the appearance of misleading tactics is likely to raise alarms and ire.

New Statewide Poll: Dewhurst’s Support Plummets, Race Narrows Between Him and Cruz

Today, we have more poll results, and they’re very, very good.

The latest Texas Tribune/UT poll shows Dewhurst at 22% and Ted Cruz at 10%.

Four observations:

1. Despite near universal name ID, only 22 percent of Texans support David Dewhurst. That would be good for a novice candidate, but it’s not encouraging for someone who has appeared on the ballot for a decade and received nearly 62 percent of the vote in his last campaign.  The bottom line: With a little more than four months before the Republican Primary, a full 78% of Texas Republicans prefer someone other than David Dewhurst for U.S. Senator.

2. The last five statewide polls were as follows:

Dewhurst Cruz
Public Policy Polling—1/19 23% 3%
Texas Tribute/UT—5/24 25% 2%
—Dewhurst enters the race—
Public Policy Polling—7/5 40% 11%
Public Policy Polling—9/22 41% 12%
Texas Tribune/UT—11/2 22% 10%

Over time, two trends are clear: Cruz’s support has more than doubled (from 2-3% to 10-12%) and Dewhurst’s has dropped by half (from 40-41% to 22%).

Dewhurst’s sinking poll numbers may explain his campaign’s major shakeup a few weeks ago — when he dismissed his campaign manager and brought in a whole new team.

3.  These poll results dovetail with the Azimuth poll released two weeks ago.  That poll showed Cruz and Dewhurst statistically tied (Cruz 32, Dewhurst 31) among the most active primary voters.  That, too, is very encouraging; it shows that when voters hear Ted’s message, it resonates, and the most informed voters are trending heavily Cruz.

4.  On a broader statewide level, which is what the Texas Tribune/UT poll measured, Dewhurst still has a significant name ID advantage.  And he’ll spend millions of dollars of his own personal wealth running TV ads trying to hide from his record and convince voters he’s conservative.  But, the more voters learn about Dewhurst’s actual record, the more his support collapses–that support is moving to Cruz.

Six months ago, Dewhurst had a massive lead.  This is now a 12-point race.

Half of the Republican voters are still undecided, but Cruz has the best ground game and a strong conservative record that will appeal to undecided Republicans.  And, having raised over $2.8 million — more than any other candidate in the race, including Dewhurst — Cruz will have the funding to get his message out.

As UT pollster Daron Shaw noted:

“Those who thought Cruz was using the Senate race as a proving ground, they may want to think again — I think it’s going to be a horse race.”
