Another Case of the Establishment VS The People

Profile PictureThe Race for Texas Supreme Court is clearly another case between the “Moderate Establishment Republicans” and the Conservative People of Texas.

As we all know in order to get elected in Texas you must wear the brand of a Conservative, therefore many claim to be but show clear signs that is not the case. Believe it or not the Austin American Statesmen get’s it right in their tagline this morning.

Medina has established political connections; Devine has support of religious, conservatives

We have John Devine who is better known as the 10 Commandments Judge vs David Medina a Texas Supreme court Judge who has been indicted on tampering with evidence and his wife was indicted for Arson. 

Runaway Grand Jury ….. or Runaway Justice?

David Medina has been on court since 2004.On January 17, 2008, Texas Supreme Court Justice David Medina and his wife Francisca Medina were indicted on felony arson related charges resulting from the 2007 fire which destroyed their home in Spring, Texas and severely damaged two nearby residences.

Justice Medina’s felony indictment was for “evidence tampering” in relation to a letter that was produced during the investigation.   Francisca Medina was indicted by two (2) separate Harris County grand juries for felony arson.

The initial fire investigator in the case felt there was compelling evidence to rule that the fire was in fact arson.   Some key factors that lead to his ruling: (1) canine detected an accelerant at the scene; and  (2) substantial financial issues relating to the Medinas’ mortgage, taxes, and other related debts.

Immediately, it was reported that the Medinas had allowed the insurance policy on their home to lapse.   Medina defenders quickly began pushing that fact as if to suggest that the Medinas had nothing to gain from the destruction of their residence since they had no insurance coverage.   Later, Justice Medina revealed in an interview that the mortgage company did take out coverage on the residence and that the forced placement policy had in fact paid off the mortgage.

A few hours after the 1st grand jury indicted the Medinas on January 17th, 2008 then embattled Harris County District Attorney Chuck Rosenthal announced he would dismiss the indictments stating that there was “insufficient evidence.”  Oddly, neither Rosenthal nor his staff had sufficient time to review the evidence considered by the grand jury in the Medina indictments prior to making the announcement of dismissal.

AUSTIN, TX– Texas Alliance for Ethical Government released a new video and website this week to expose the deliberate smear campaign launched against the 1st Harris County grand jury that indicted Justice David Medina and his wife Francisca on felony arson related charges in 2008 through the organization’s public education project:  RunawayGrandJury.Org. 

The video titled, “Runaway Grand Jury….or Runaway Justice?” can be viewed at:  http://www.runawaygrandjury.org 

In an attempt to downplay the indictment of Justice Medina and discredit the grand jury, the Medina legal teams labeled the jurors as a “Runaway Grand Jury” and made statements implying they were all “agenda driven …liberal … Log Cabin Republicans … drunk with power … trying to rid Texas of conservative Republican judges.”

The hard-hitting video reveals the fact that the 1st grand jury was in truth comprised of a large number of “conservatives” and several very “staunch” Republicans as detailed on the website at Meet the Jury.  

Dave Welch,  Texas Alliance for Ethical Government board member stated, “Contrary to the character attacks launched by Medina’s legal team (often with Medina present) several of the jury members have served the Texas GOP as precinct chairs, state convention delegates, and convention committee members.”  Welch further added, “Oddly enough, there are 3 National GOP Convention delegates among the grand jury members that indicted Justice Medina and his wife in January of 2008.”  

After the 1st grand jury indictments were handed down against both David and Francisca Medina, the District Attorney’s office made the surprising discovery that they failed to “properly extend” the original term of that grand jury.  It seems incompetence ran as deep as cronyism and corruption during that time period in the Harris County District Attorney’s office. 

“Until now, the Medina legal teams got away with their efforts to discredit and silence the 1st grand jury, going so far as to ask the court to consider jail time and fines if the jurors dared defend their integrity or service as jurors,” said Alice Linahan, Texas Alliance for Ethical Government board member.  Linahan stated additionally, “With the true composition of the 1st grand jury finally revealed, it will be difficult for the public to believe that these jurors had an “agenda” as suggested or that two separate grand juries inHarrisCounty got it wrong two times in this one arson case.”

Several mysteries still remain in the Medina arson indictment saga.  What did happen to that letter that was the basis of Justice Medina’s felony indictment for “evidence tampering” – did it get lost on the way to the 2nd grand jury proceeding?

Why are Republican Elected Officials endorsing David Medina?

I am completely blown away be the fact that these Republican elected officials are endorsing David Medina for Texas Supreme Court.

My question is have they actually vetted David Medina. Do they know DAVID MEDINA’S DUBIOUS RECORD  If they do why in the world would they publicly endorse him.

My prayer is that they simple do not know and will ask to be taken off his list of endorsements.  Below is important information about Judge David Medina. After you know about his dubious record tell me  can you in good conscience endorse and vote for David Medina.

Was it David Medina that investigators thought torched the Medina home in Spring, Texas, or was it a disgruntled Mrs. Medina? 

Was this an experienced and trustworthy grand jury?

In 2008 a grand jury returned felony indictments against Texas Supreme Court Justice David Medina and his wife.  Mrs. Medina was accused of setting a blaze with an accelerant found in their garage that caused almost $1 Million worth of damage to three homes in their Spring, Texas, neighborhood, including their own 5,000-foot home.

What made investigators suspicious is that the Medinas had been sued in June 2006 by a mortgage company. The suit was filed because the family had missed five months of payments.The investigators also learned that the Medinas owed $1,900 in fees to their homeowners’ association.

In a November interview with the AP, the Medina’s financial problems were publicly revealed. Ironically, the losses from the fire were not covered because unbeknownst to the Medinas, the homeowners insurance policy had lapsed.  After the fire, the Medinas sold their home in Spring and moved to Austin, Texas.

For this felony, Mrs. Medina’s bail was set at $20,000.  TSC Judge David Medina was indicted for tampering with evidence (a felony), and his bail was set at $5,000. Dick De Guerin was Mrs. Medina’s lawyer.

To show how politically rotten this whole situation became, the District Attorney (Charles A. Rosenthal, Jr.  — also a Republican) decided to dismiss the grand jury’s indictments because of a procedural error made by the DA’s office.

By law, grand jury deliberations must be kept secret; but the jury foreman did state, “The testimony of the arson investigator is what we went on…Draw your own conclusion if it was sufficient.”

Both the grand jury foreman and the assistant foreman (an experienced civil trial lawyer) said the DA’s office had already decided beforehand to oppose the indictments against the Medinas. The foreman stated, ”If this was David Medina,  truck driver of Baytown, Texas, he would have been indicted three months ago.”

Even though the grand jury had returned guilty indictments against both the Medinas, the DA’s office managed to get the judge to void the grand jury’s vote. To keep the grand jury members from telling their side, the prosecutor placed an injunction over them that gagged them from talking under threat of jail time.

Ironically, District Attorney Rosenthal himself was later forced to leave office because of love notes and sexually explicit messages sent from his office.
